| 1. | When VASPs assess whether an individual remains a Fit and Proper Person, they shall assess the role such individual is actually performing at the time the assessment is done. |
| 2. | In addition to all of its other powers of enforcement, if VARA is of the view that an individual is no longer a Fit and Proper Person, it may—
|
| | a. | revoke or suspend the approval granted to such individual or the Licence of the relevant VASP; |
| | b. | publicly or privately reprimand such individual; |
| | c. | prohibit such individual from applying again; |
| | d. | impose a fine or other non-financial penalties in the event of a material breach of this Part III of the Company Rulebook; |
| | e. | require the VASP to implement additional measures or controls; and |
| | f. | take any other enforcement action as determined by VARA.
